Marcoleta miinsistir nga makabotar gihapon isip senator-judge bisan napriso

Miinsistir si Senador Rodante Marcoleta nga dili babag ang iyang pagkabilanggo aron matuman ang iyang katungdanan isip senator-judge sa impeachment trial ni Vice President Sara Duterte.

Sa sulat niadtong Hulyo 20, 2026 ngadto kang Senate President Sherwin Gatchalian ug Presiding Officer Francis “Chiz” Escudero, miingon si Marcoleta nga nagpabilin ang iyang legal nga katungod sa pagbotar.

“There is no impairment to my legal capacity to vote as a senator-judge, for I am not under preventive suspension,” matod ni Marcoleta.

Gikutlo ni Marcoleta ang probisyon sa Senate Rules on Impeachment nga nag-ingon:

“The president of the Senate shall, in the event any senator cannot personally cast his/her vote due to any valid reasons, prescribe the manner and procedure on how the vote shall be cast and communicated to the chamber.”

Base niini, miingon si Marcoleta nga dili mawala ang katungdanan sa mga senador tungod lamang kay sila napriso, nagtago, gisuspenso, naospital, o atua sa gawas sa nasod, basta dili sila permanente nga dili na makahimo sa ilang katungdanan.

Bisan miinsistir nga adunay katungod sa pag-apil, misuporta si Marcoleta sa 16-vote threshold ni Escudero, nga gibase sa constitutional requirement nga “no person shall be convicted without the concurrence of two-thirds of all the members of the Senate.”

Gipasiugda usab niya nga walay senador nga misupak sa maong ruling sa dihang gihimo kini.

“There were 21 senator-judges present. No one objected to the foregoing ruling. It is therefore the prevailing ruling of the impeachment court. I vote in favor of the foregoing ruling and reasoning,” matod niya.

Apan misupak si Marcoleta kang Escudero bahin sa iyang pagkapili isip presiding officer.

Gisupak niya ang boto niadtong Hunyo 3 nga nagpalingkod kang Escudero sa maong posisyon, nga giaprobahan sa 12 sa 24 ka senador atol sa plenary session nga wala tambongi sa majority bloc, nga niadtong panahona gipangulohan ni karon Senate Minority Leader Alan Peter Cayetano.
